Man indicted for rape here illegally, records show

A Dalton man who is accused of raping a 9-year-old girl on July 11 and who is in the country illegally, according to jail records, has been indicted by a Whitfield County grand jury.
Miguel Francisco Pablo-Garcia, 26, of 516 Candran St., was indicted for rape, two counts of aggravated child molestation, two counts of child molestation, enticing a child for indecent purposes, sexual battery, felony statutory rape, false imprisonment, three counts of forgery in the first degree and two counts of falsifying identification documents.
According to a police report, Garcia entered the child’s house and raped her while her father slept. The report said the girl was an acquaintance of Pablo-Garcia.
Records from the Department of Homeland Security’s Immigration and Customs Enforcement division show Pablo-Garcia, who was born in Guatemala, is not legally in the United States and appears to be subject to removal proceedings, but he has an application for appeal pending, according to booking records at the sheriff’s office.
Also indicted were:
• Odir Albin Alas was indicted for terroristic threats and acts and driving under the influence of drugs or alcohol.
• Benjamin Albert Alday was indicted in three separate cases. In the first case, he was indicted for burglary. In the second, he was indicted for entering auto and criminal damage to property (second degree). In the third case, he was indicted for entering auto, financial transaction card forgery and six counts of financial transaction card fraud.
• Robin Shantee Anderson was indicted for two counts of illegal possession of a controlled substance, possession of tools for commission of crime, possession of drug-related objects and two counts of reckless conduct.
• Robin Denise Arthur was indicted for forgery (second degree), theft by taking, giving a false name or false information to police, and being a habitual felon.
• Luis Javier Arrendondo was indicted for possession of cocaine.
• Emmanuel Delgado Arzate was indicted in two separate cases. In the first case, he was indicted for aggravated assault, giving a false name or false information to police, and violation of the Street Gang Terrorism Act. In the second case, he was indicted for illegal possession of a controlled substance, purchase/possession/control of marijuana and violation of the Street Gang Terrorism Act.
• Christopher Shamere Asbeury was indicted for terroristic threats and acts, theft by shoplifting, simple assault, underage consumption of alcohol and criminal trespass.
• David Daniel Avila was indicted for possession of cocaine.
• Alverto Salas Barrientos was indicted for three counts of battery, false imprisonment, terroristic threats and acts, and cruelty to children.
• Darvin Ray Boggs was indicted for illegal possession of a controlled substance.
