A man accused of raping an adult family member nearly two years ago is on trial in Whitfield County Superior Court this week, but his attorney says evidence of the alleged crimes just isn’t there.
James Ray Green, was 44 and living in Cohutta when he was charged Oct. 8, 2010 by the Dalton Police Department with forcible rape and incest in at least one incident alleged to have happened at the Downtown Motor Inn weeks before.
Police have previously said the alleged victim was taken to Hamilton Medical Center on the date the rape was supposed to have occurred and that staff members there alerted the police department after seeing her.
A jury was selected on Monday to hear the case in Judge David Blevins’ courtroom. The trial is expected to last through the end of the week.
Defense attorney Richard Murray during an opening statement Monday said the evidence during the trial will show there were “issues with the family” that lead to the accusations, and he said the physical evidence — or lack thereof — is also questionable.
