Murder trial could start this month

— Attorneys for both sides in a double murder case have said they are ready for trial and could be in court on Monday, July 15, before Superior Court Judge William T. Boyett.

Emilio Christopher Canales, 28, was living at 1011 Dude St., off North Hamilton Street, when he was charged in April 2012 by the Dalton Police Department in the shooting deaths of his father, Emilio Canales Sr., 50, and brother, Emilio Francisco Canales, 31, and with shooting and injuring his mother, Deborah J. Canales. He has pleaded not guilty.

District Attorney Bert Poston said there are older cases that might be tried first and delay Canales’ trial. He said he expects to know more about the scheduling in a few days.

A grand jury indicted Canales in April on six counts of murder, attempted murder, five counts of aggravated assault, three counts of possession of a firearm during the commission of a crime, three counts of possession of a firearm by a convicted felon and for being a habitual felon. Poston said some of the multiple counts are because of nuances in the law.
