Homeowner says electrocuted swimmer was trespasser

— A middle Georgia homeowner being sued after a woman was electrocuted while swimming beside his dock says he’s not responsible for her death because she was trespassing.

The Telegraph of Macon reports Carey Merrell of Eatonton says a chain was blocking the driveway of his home on Lake Sinclair the day 25-year-old Devin Olivia Powers was killed in May 2012.

An attorney for Powers’ family filed a wrongful death lawsuit against the homeowner last week in Bibb County Superior Court. The suit says Powers was treading water when she touched Merrell’s dock and came into contact with an outlet box or exposed wire. An autopsy found she died from electrocution.

Merrell says the woman’s death was “a tragedy” but insists he’s not to blame.
